Virginia ABC Laws & Regulations

Code of Virginia – Laws set by the General Assembly each year govern a variety of winery activities. Specific sections pertaining to the wine industry include:

Title 3.2- Agriculture, Animal Care, and Food (VDACS)

Title 4.1- Alcoholic Beverage Control Act

Title 10.1- Conservation (Environment)

Title 15.2- Counties, Cities and Towns (Local Government)

Title 58.1- Taxation

Virginia Administrative Code – Regulation by state agencies carry out the Code of Virginia (laws set by the General Assembly). For the wine industry, the ABC regulations are primarily enforced by Virginia ABC special agents and are targeted at ABC licensees (including Farm Wineries). 3 VAC-5-10 contains a summary of all the ABC regulations

Federal Laws & Regulations

Alcohol and Tobacco Tax and Trade Bureau (TTB): The mission of the TTB is to collect Federal excise taxes on alcohol, tobacco, firearms, and ammunition, and to assure compliance with Federal tobacco permitting and alcohol permitting, labeling, and marketing requirements to protect consumers. TTB's main responsibilities are protecting the public and collecting the revenue. They carry out these responsibilities by developing regulations, conducting product analysis, ensuring tax and trade compliance with the Federal Alcohol Administration Act and the Internal Revenue Code. TTB has an extensive wine FAQ section on their website that can answer many of your day to day operational questions.

TTB has a large section of their website designated to wine labeling, permitting, taxes, wholesale/import/export, etc.

TTB also allows for your COLAs, basic permit and other paperwork to be completed and submitted online. By submitting online you can dramatically decrease the processing time of your paperwork and applications.
